1. Acceptance of Terms
By creating a HostingDon account, signing up for any plan, or using any portion of our hosting services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, you must not use the Services.
If you're agreeing on behalf of an organization, you represent that you have authority to bind that organization. In that case, "you" means both you personally and the organization.
You must be at least 18 years old, or the age of majority in your jurisdiction, to enter into this agreement.
2. Definitions
- "Services" means the hosting products HostingDon provides — including shared web hosting, managed WordPress hosting, cloud hosting, and any related services such as domain registration, email, SSL certificates, and backups.
- "Account" means your customer account at hostingdon.com.
- "Customer Content" means any data, files, code, text, images, or other material you upload to or store on the Services.
- "Order" means the specific subscription, plan, or product you purchase from us.
- "Subscription Term" means the period for which you've paid (monthly, annually, etc.).
3. Your Account
You're responsible for keeping your account credentials secure. You must use a strong, unique password and enable two-factor authentication where available. Notify us immediately at security@hostingdon.com if you suspect unauthorized access.
You must provide accurate registration information and keep it up to date. Providing false information, impersonating another person, or operating an account on behalf of someone you haven't disclosed are grounds for immediate termination.
One person or organization may hold multiple accounts, but you may not create accounts to evade suspensions, abuse promotional pricing, or circumvent resource limits.
4. The Services
HostingDon provides the Services described on our website and in your Order confirmation. We may modify, add, or remove features over time, but we will not materially reduce the core capabilities of a Service you're paying for during your current Subscription Term without offering you a comparable replacement or a prorated refund.
Some features depend on third-party providers (for example, domain registration runs through accredited registrars; SSL certificates are issued by certificate authorities). Your use of those features is also subject to the third party's terms, where applicable.
5. Billing, Renewals & Refunds
5.1 Payment
You agree to pay all fees for your Order in advance, in the currency specified at checkout. Fees do not include taxes; you are responsible for all applicable VAT, GST, sales taxes, and similar charges, which we will collect where legally required.
5.2 Auto-renewal
Unless you cancel before the renewal date, your subscription will renew automatically at the then-current standard rate (not the introductory rate). We will email you a renewal notice at least 15 days before each renewal so you have time to make a decision. You can disable auto-renewal anytime from your account dashboard.
5.3 30-day money-back guarantee
If you're not satisfied with your hosting service for any reason, you can request a full refund within 30 days of your initial purchase. Email billing@hostingdon.com from your registered address and we'll process the refund within 5 business days. The guarantee does not apply to:
- Domain registration and renewal fees (these are paid to registries upfront and are non-refundable);
- Add-on services billed separately, such as paid SSL upgrades or premium add-ons used during the period;
- Renewals after the first 30 days;
- Accounts terminated by us for violations of the Acceptable Use Policy.
5.4 Late or failed payments
If a payment fails, we'll attempt to retry the charge over the following 7 days and notify you. If payment isn't received within 14 days of the original due date, we may suspend the Services. Data is retained for 30 days after suspension, after which it may be permanently deleted.
6. Acceptable Use
Your use of the Services is subject to our Acceptable Use Policy, which is part of this agreement. Violations may result in suspension, termination, or legal action depending on severity.
7. Your Content & Backups
You retain all rights to Customer Content. You grant HostingDon a limited, worldwide, non-exclusive license to host, store, transmit, and display Customer Content solely as necessary to provide the Services to you.
You're responsible for the legality of Customer Content and for ensuring you have the right to use, distribute, and store it.
We provide automated daily backups for most plans, retained for the period stated on each plan's product page. Backups are a convenience, not a guarantee. You should maintain your own independent backups of any data critical to your business. We are not liable for data loss except as expressly stated in these Terms.
8. Service Level Agreement
Uptime guarantees, service credits, and exclusions are set out in our Service Level Agreement, which forms part of this agreement.
9. Intellectual Property
All HostingDon software, branding, documentation, dashboards, and proprietary tooling remain the exclusive property of HostingDon Inc. and our licensors. Nothing in these Terms transfers any IP ownership to you.
You may not reverse engineer, decompile, or attempt to extract the source code of our control panel, internal tooling, or proprietary platform components.
10. Termination
10.1 Termination by you
You can cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period; you'll continue to have access until then. After cancellation, your data is retained for 30 days, then permanently deleted.
10.2 Termination by us
We may suspend or terminate your account immediately if you (a) materially breach these Terms or the Acceptable Use Policy, (b) fail to pay invoices when due, (c) use the Services in a way that risks harm to our infrastructure or other customers, or (d) are required to do so by law.
We may terminate accounts with 30 days' notice for non-cause reasons (such as discontinuing a product line). In that case, we'll prorate any unused portion of your subscription.
11. Disclaimers & Warranties
HostingDon provides the Services "as is" and "as available." Except for the express commitments in these Terms and our SLA, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
We don't warrant that the Services will be uninterrupted, error-free, or that all data loss will be preventable. We do warrant that we'll meet the performance commitments in our SLA, with the remedies set out there.
12. Limitation of Liability
To the maximum extent permitted by law, HostingDon's total liability arising out of or relating to these Terms or the Services is limited to the greater of (a) the fees you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD $100.
Neither party is liable for indirect, incidental, consequential, special, or punitive damages — including loss of profits, revenue, business opportunity, or data — even if advised of the possibility.
These limitations don't apply to (i) breach of confidentiality, (ii) infringement of the other party's IP, (iii) gross negligence or willful misconduct, (iv) indemnification obligations, or (v) liabilities that cannot be limited under applicable law.
13. Indemnification
You agree to defend, indemnify, and hold HostingDon harmless from any third-party claims arising out of (a) Customer Content, (b) your violation of these Terms or applicable law, or (c) your use of the Services in a way that infringes someone else's rights. We'll notify you promptly of any covered claim and let you control the defense, with our reasonable cooperation.
14. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. The federal and state courts located in Wilmington, Delaware have exclusive jurisdiction over any dispute arising under these Terms.
If you're a consumer in the European Union, the United Kingdom, or another jurisdiction whose mandatory laws give you additional protections, those protections are not waived by this section.
Before filing any legal action, you agree to first contact us at legal@hostingdon.com with a written description of the issue. We'll attempt in good faith to resolve the dispute within 30 days.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll notify you by email and post the updated Terms with a new "Effective" date at least 15 days in advance. Continued use of the Services after the effective date means you accept the updated Terms. If you don't accept, you can cancel and request a prorated refund of unused subscription time.
